The CBI filed an untraced report in the Sippy Sidhu murder case at the Special CBI Court today.
National-level shooter and advocate Sukhmanpreet Singh Sidhu, alias Sippy Sidhu, was shot dead on September 20, 2015, at a park in Sector 27. A .12 bore gun was used in the crime and four bullets were fired from it. A case of murder was registered at the Sector 26 police station. In January 2016, the case was transferred to the CBI.
The CBI today filed the final report under Section 173 of the CrPC in the case, but the report was incomplete as documents and statements of the witnesses mentioned in the report were not submitted by the CBI.
In the report, the CBI submitted that despite a thorough investigation, the agency could not gather sufficient evidence against the accused and she had not been chargesheeted in the case. However, the CBI mentioned that the investigation was being kept open and requested directions under Section 173 (8) of the CrPC to continue further investigation. Also, a request was made to accept the untraced report in the case. However, the CBI court stated: "The document submitted by the CBI is purported to be the final report under Section 173 of the CrPC, wherein they have mentioned that the accused has not been chargesheeted for want of evidence but at the same time, it has been mentioned that the investigation is being kept open".
"The court in these circumstances fails to understand that how this report can be treated as the final report when the CBI is still willing to keep the investigation open and if the investigation on certain aspect is still pending at the end of the CBI, then why are they filing the untraced report," observed the court.
However, the court directed the investigating officer to clarify the nature of the document submitted by the CBI as whether it was the final report or untraced report or simple status report.
