Disposing of an application filed by RTI activist and AAP leader Dinesh Chadha, the National Green Tribunal (NGT) has termed it a failure on part of the state government regarding compliance of its orders to stop illegal mining and recovery of compensation from offenders in the district.
Chadha had filed an application seeking sentencing of the respondents — Chief Secretary; Secretary, Industries; Secretary, Mining; Deputy Commissioner, Ropar, and the Chairman of the Central Pollution Control Board for violation of orders of this Tribunal under Section 26 of the NGT Act, 2010.
Observing that failure to comply with order of the tribunal was a criminal offence punishable for a term extending up to three years or with a fine up to Rs 10 crore, the NGT order stated that under Section 30 of the NGT Act, 2010, cognisance of an offence can be taken by a Metropolitan Magistrate or a Judicial Magistrate first class. The Tribunal's jurisdiction does not extend to conducting trial for the offence, as per scheme of the Act, stated the order of tribunal headed by Justice Adarsh Kumar Goel, Judicial member Justice Sheo Kumar Singh and expert member Dr Nagin Nanda.
In 2017, district administration officials during their visits to various quarries found illegal and unregulated mining. Chadha had moved the NGT in 2018 to seek action against the offenders and the tribunal asked a joint committee of the Central Pollution Control Board, Director (Mining) and the Punjab Pollution Control Board to stop illegal mining. — TNS
